Rowan’s practice in Gibraltar includes advisory and advocacy services (including for Hassans) in a range of commercial, trusts & chancery, insolvency (including cross-border) and public law cases. Case work includes Reclaim Limited (In Liq) – acting for PWC (claims against ex-directors for breach of fiduciary duty; and against law firm third party trustees in Spain and for unlawful dissipation), and acting for the executor in contentious probate proceedings. He is happy to assist with cases, large or small; simple or complex.

Rowan’s past reported cases in Gibraltar include the following:

The Estate of Lewis Francis v HM Attorney General [2018] – (Court of Appeal for Gibraltar: with John Restano QC, represented successful appellants in constitutional challenge to rent control legislation (right to property, proportionality/ legitimate aim). See GBC news coverage here.

Ansaldo’s Townhouse Ltd v Sharrock Shand Ltd [2017] (Supreme Court, Gibraltar: enforceability of an adjudication clause in an amended JCT construction contract).

Rowan’s international and UK practice includes high value and complex civil fraud, commercial, insolvency and arbitration, including cross-border recognition and enforcement matters. Examples include the following:

  • High Court civil fraud /breach of trust and dishonest assistance claim (£32m), in the context of a property development and investment dispute.
  • Appearing for the claimants in £27m renewable energy arbitration (LCIA, London) (on-shore run of the river facility in Africa – payment dispute / breach of warranty / output performance).
  • Dean v Bhim [2019] UKPC 10 (Privy Council, sole counsel – acting for successful respondent in challenge to a will).
Public law work includes housing, education, planning and cases spanning the public-private law divide (procurement, planning, environment and commercial immigration). Recent cases include Patel v Secretary of State for the Home Department here [2019] UKSC 59 (UK Supreme Court, the right to reside and to citizenship under the TFEU – scope of Zambrano decision).
